The Nature of UK Constitution

In this article, I have described the key questions like, What is the difference between Unwritten and Uncodified Constitutions? what is the nature of the UK constitution/British constitution, what is the constitution of England Nature?

Introduction:

The United Kingdom has always been a nation based on laws and rules. The majority of these laws have been present in the constitution, a set of established laws that defines the legal framework within which the country’s government operates. The constitution of the United Kingdom is the document that sets out the framework for the formation and role of the executive, legislature, and judiciary.

It is wrong to remark that the UK has no Constitution. In fact, the Constitution of the UK is uncodified which means that it has not been brought together in a single document. It has both written and Unwritten parts. The written part includes leading statutes, judicial decisions, and treaties.

Examples of constitutional statutes include the Bill of Rights 1689, Parliament Acts 1911 and 1949, etc.

While Unwritten part includes Conventions that form the major part of the constitution. Conventions are always obeyed and any deviation from them is against the very spirit of the constitution. Its examples include the monarch acting on ministerial advice and the PM sitting in the House of Commons.

It is different from other countries, which have a proper codified constitution. However, New Zealand and Israel also share the same feature of the uncodified constitution with the UK.

Codified constitutions are mostly the result of a major historic turning point, such as the grant of independence, revolution, defeat in war, or complete collapse of the previous system of government. The UK has never experienced such a constitutional moment. The UK Constitution is an evolutionary Constitution that has evolved through different stages throughout history. It has never experienced such kind of revolution which could change the very spirit of the constitution.

The major question which arises in the mind is why the UK has not felt the necessity to have a codified constitution?

The most reasonable answer to this question is that the uncodified constitution of the UK has worked very well for them and they have not faced any situation in which it was necessary to switch to a codified constitution. In addition to it, the uncodified Constitution is a legacy of many years and they do not want to disrupt it because it is something of which they are very proud.
